Terms of use
These terms apply to The Learning Forest at learn.thetreefella.co.uk: the website, the app and its modules. By making an account or using the app you agree to them. If your school uses the app, our data processing agreement with the school also applies, and wins if the two disagree.
1. Who we are
The Learning Forest is run by The Tree Fella NE Ltd, trading as The Tree Fella®, registered in England & Wales, company number 11632007, 16 Prince of Wales Close, South Shields, NE34 6QT. Email learn@thetreefella.co.uk.
2. The service
- The Learning Forest is free. We may add, change or remove modules and features.
- If we decide to close the service or start charging for it, we will tell account holders by email at least 30 days before, so you can keep or delete your data first.
- We aim to keep it running and your data safe, but we can't promise it will always be available or free of errors. It is provided as it is.
3. Who can use it
- Grown-up accounts are for adults: parents, carers and teachers. You must be 18 or over to make one.
- Children use the Forest Pass or picture login that their grown-up or teacher makes for them. Children don't make their own accounts.
- A teacher who adds pupils for a school must do so with the school's agreement. The school is responsible for its pupils' data, as set out in the data processing agreement.
4. What we ask of you
- Use first names, nicknames or initials for children. Don't enter surnames, dates of birth, or anything sensitive such as health or special educational needs information.
- Keep your password and children's Forest Passes safe. If a Forest Pass is lost, make a new one in the app; the old one stops working.
- Only set up class devices on devices the school controls.
- Don't try to get into other people's accounts, interfere with the service, or copy it at scale.
5. The learning content
- The modules are practice and learning tools. They support teaching and learning at home; they don't replace them, and we can't promise any particular result.
- How does a tree work? explains tree science simply, for young children. It simplifies on purpose and credits the books it follows. It isn't advice about a real tree; for that, ask a qualified arborist.
- The practice check in Grow your times tables is our own. It isn't connected to, or endorsed by, the Department for Education or the Standards and Testing Agency, who run the Year 4 Multiplication Tables Check.
6. Our content
The words, pictures, diagrams and software are © The Tree Fella. You may use them for teaching, learning and at home, including in the classroom. Please don't republish them, or use them commercially, without asking us.
7. Accounts and ending
- You can delete your account at any time in the app ("Delete my account"). Everything on it is deleted straight away.
- Pupils who haven't played for 12 months, and grown-up accounts unused for 12 months with no pupils left, are deleted automatically.
- We may suspend or close an account that breaks these terms or puts other users at risk. Where we can, we will tell you first.
8. Privacy
How we use personal data is in our privacy notice, and in full in what we store. There are no adverts, no tracking and no analytics.
9. Our responsibility to you
- The service is free. To the extent the law allows, we aren't responsible for any indirect loss, or for loss caused by things outside our reasonable control.
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't let us limit. If you use the service as a consumer, your legal rights are not affected.
10. Changes and complaints
- We may update these terms. The date at the top shows the latest version. We will tell account holders by email about any change that matters.
- If something isn't right, email learn@thetreefella.co.uk and we will try to sort it out.
- These terms are governed by the law of England and Wales.
